Mental health stigma in the workplace is rife in some organisations. Those suffering are offered very little recourse in such situations and often find that in relation to personal or psychological injury claims, they are shut down and employers are not held to account. This is particularly the case if the employee has a pre existing mental health illnesses and/or disabilities. However, with reasonable knowledge of an employees’ mental health disability, an employer should be well aware of the impact of their behaviours on those with mental health disabilities in the workplace in particular, in relation to bullying. 

This petition calls for employers to be held to account for injury where workplace bullying is found to be a cause of mental ill-health or a major contributing factor in the deterioration of an employees mental health disability. This should trigger mandatory training for organisations in mental health awareness and how to support employees with mental health disabilities. 

It also calls for changes to  health and safety at work in that employers should be legally obligated to report a workplace suicide or a suicide attempt where workplace bullying has been alleged for a full and fair investigation. 

Workplaces should also report overall staff absence due to work related stress and exacerbation of mental health disability symptoms to the health and safety executive for investigation, this should occur regardless of settlements to protect the employees and productivity within our workforce. 

Where employers fail to make the appropriate reasonable adjustments, it should immediately be reported for investigation to the Health and Safety Executive. 

Employees with mental health disabilities can thrive thrive in the workplace and be some of the most productive workers. This can only happen if their rights are well protected.
