Chapter 2 of the Code of Professional Conduct of BC Law Society states that BC lawyers must at all times:
- promote the interests of the state
- serve the cause of justice
DLA Piper lawyer Chris Bennett, acting on behalf of Real Estate Board of Greater Vancouver (REBGV), is attempting to silence the independent newspaper ThinkPol with threats of legal action that are not based in law or precedent.
Bennett's intention seems to be to use threats of frivolous and vexatious litigation to stop ThinkPol from reporting on unethical activities of REBGV.
Freedom of the press is enshrined in the Canadian Charter of Rights and Freedoms.
2. Everyone has the following fundamental freedoms:
(b) freedom of thought, belief, opinion and expression, including freedom of the press and other media of communication;
Chris Bennett is attempting to deny Canadian citizens the freedom of press through frivolous and vexatious litigation.
This is a clear violation of the Code. As such, Chris Bennett should be disbarred immediately and forthwith.
