Kenya is at a Crossroad in terms of its progress towards a fully democratic, transparent and accountable governance including its respect to the rule of law and respect for human rights because of the refusal of its leadership to abide by the 2010 constitution,  and its many provisions that include among others enhanced community participation in decision making and a clear separation of powers between the three arms of government namely Executive, Legislature and Judiciary. 

As a consequence there is now increasing tendency by the political class to emasculate the independence of the judiciary by refusing to abide by court orders and to comply with the rule of law while resorting to personal pronouncements not supported by law. 

As a consequence, the rogue government in Nairobi has resorted to forcing into exile its critic and human rights  and civil society leader Miguna Miguna. Despite several court orders requiring the government to allow, facilitate and not to interfere with the return of Mr Miguna Miguna to the country, the leadership has refused to comply and continue to fragrantly disobey these court orders.

This should worry the international community as it sets a bad precedence of monumental proportions not only for Kenyans, but to the entire international community, that the law in Kenya can be applied selectively at the whims of the political class. This should not just worry Kenyans but any investor living or who intends to invest in the Kenyan economy as it creates a rule in the jungle scenario.

This has led to runaway corruption and theft of public funds running in trillions of Kenya shillings lost due to pilferage, theft, plunder and corruption facilitated by cronies of the political leadership as a result of impunity and the feeling of being above the law. This is causing death of hundreds of Kenyans due to misappropriation of funds meant for the healthcare, education and social sector hence promoting spread of diseases, poor social amenities, amongst others with its attendant security risks. 

As a first step in reestablishing the rule of law, respect of human rights, justice, equity and preventing impunity within the ruling political class, we appeal that you join us in this petition whose goal it is to seek international support to force the ruling cabal in Nairobi to

1. Withdraw the forced exile of Mr Miguna Miguna by obeying and upholding the court orders allowing him to return to Kenya unconditionally

2. Require all governments to freeze all assets acquired through theft, pilferage, and looting of public resources and held by the ruling class, their families and cronies outside of the country

3. Support civil rights groups and the judiciary materially, politically and in terms of capacity to continue holding the political leadership to account

4. Withdraw diplomatic visas and immunity for any of the leadership, their allies, cronies directly or indirectly involved in this breach of fundamental human rights of the Kenyan people including the civil rights of Miguna Miguna
