We are shocked to read the news reports suggesting that the Government of Jammu and Kashmir is imposing ban and closure on the schools run by Falah-e-Aam Trust (FAT). The statement of Mr. Khurshid Ahmad Ganai, Advisor to Governor saying that there will be no random ban on Jamaat-e-Islami run schools fails to clear the Government’s intent. Therefore, we feel compelled to write to the Union Government of India and the Government of Jammu and Kashmir via public media that FAT is a registered trust (Govt. Regd. vide no. 159/s; dated 31 July 1972) that runs as per the constitution duly submitted to the State. The objectives of the FAT as stated in article 3 of its constitution include providing assistance to the poor and needy without discrimination of religion, color and creed, help in the education of the poor and needy students, open education institutions to educate students from all the shades of the society without any discrimination, and to assist any organization that performs humanitarian work (e.g. the 2014 Kashmir floods).

Falah-e-Aam Trust (FAT) is non-political in nature and is dedicated to education and service to mankind (article 4 of the FAT constitution). It was after 1971, when Mr. Sheikh Muhammad Abdullah banned any political party to run any educational institutes, these schools were detached from the Jamaat-e-Islami (JeI) organization to remain apolitical, charitable, and a social welfare organization in its nature.

At present, FAT runs over 350 schools across the state of Jammu and Kashmir, with enrollment of over 100'000 students and approximately 10'000 staff members.

FAT boasts of a strong alumni who have witnessed its struggle to educate the weaker sections of the society and its efforts to uplift the society in a positive manner. No school run by FAT has ever taught to breach the law of the land or engage in anti-social activities. These schools teach syllabi as prescribed by the J&K State Board of School Education. FAT schools have created several hundred thousand civilized citizens holding important positions in almost every important office in the State, including those of the state administration and state education. These schools have greatly elevated the literacy rate in the state and contributed to its economic development and per-capita growth. 

Earlier, the then Governor of the J&K state, Mr. Jagmohan Singh banned and closed down all the schools run by FAT in 1990 and it was the Honourable Supreme Court of India that rejected the ban as illegal, unfounded, and revoked the ban resulting in the re-opening of these schools. Any ban on FAT schools by the Government today would not only be illegal but also a threat to education of over hundred thousand students who are enrolled at these schools. It will also lead to massive tensions on the already fragile ground situation of the state of J&K state.

We hereby request the Union Government of India and the officials of the state of J&K to avoid any ban and closure of the FAT schools. In case, the government of the day imposes the ban, it would mean that the current dispensation is against the education of weaker sections of the state. The ban will jeopardize the education and career of thousands of students and render many jobless. We hope that our voices are heard and FAT run schools are allowed to run smoothly without undue state interference. We will resist any ban on the FAT schools through legal and democratic means. We will not allow generations to lose their right to good education.
