On the letter and spirit of the Indian Constitution

 

Remarks of DrBhim Rao Ambedkar in a speech to the Constituent Assembly of India on Thursday, the 4th November 1948: “I feel that the Constitution is workable, it is flexible and it is strong enough to hold the country together both in peace time and in wartime. Indeed, if I may say so, if things go wrong under the new Constitution, the reason will not be that we had a bad Constitution. What we will have to say is that Man was vile”.

 

About 34% of the MPs in Lok Sabha 2014 have Self-declared criminal cases against them. This does not conform to the spirit of the Indian Constitution; as per the vision, dreams and hopes of our founding fathers.

 

All electronic voting machines (EVMs) now have a "None of the Above (NOTA)” button below the name of the last contesting candidate. If the voter presses the button next to NOTA, his desire not to vote for any of the candidates in the fray will get recorded in the EVM in secrecy.

 

Most political parties continue to field corrupt and criminal candidates. ‘WE, THE PEOPLE’ have today become slaves to the letter of the Indian Constitution. If you are convinced that no candidate is acceptable, kindly do NOT abstain from voting. Please,‘Vote for NOTA’.

 

PEACEFUL MORAL PUBLIC PRESSURE

If, the votes polled by a candidate, declared elected officially, are LESS than the votes in favor of NOTAthen, the winner candidate has lost his moral authority to represent the voters as per the spirit of our Indian Constitution.He must be requested to quit, and if need be, by PEACEFUL MORAL PUBLIC PRESSURE only. This must be an absolutely NONVIOLENT approach as practiced by the father of our nation, Mahatma Gandhi during the Quit India movement of our freedom struggle.

 

If over 50% “Vote for NOTA” and the winner candidate refuse to quit; we will approach the judiciary to seek justice as per the spirit of the Indian Constitution. Living with a criminal lawmaker for five years ismanythousand times more expensive than a re-election.

 

This idea must be given a practical shape in our elections. It will spread the message that the voter can put an end to the criminalization of politics and thereby transform the Indian political landscape. Using NOTA is an idea whose time has come.

We are the world’s largest democracy. The voter would like to vote only for a candidate with character, ethics, moral values and integrity. We must vote for a person with a vision and a record of selfless service for the society at large. But, our elections are more of a joke in the name of democracy. The number of elected criminals and corrupt lawmakers is going up with every election.

 

‘We, the People’ will continue to be victims of crime and corruption in our daily life unless we realize that we have to get to the root of the problem and sincerely consider using NOTAat the time of elections.

 

Today, India has the potential to not only be a regional but also a world power. This can happen only if we can first ensure honesty and discipline with our lawmakers. No country can ignore the rapid economic and military progress being made by its neighbors. Tomorrow may be too late.

 

Voters have for decades taken it for granted that they have no choice but to live with an electoral system that is incapable of preventing criminals from becoming legislators. By exercising the power and option under NOTA, ‘We, the People’ can stop criminals from being elected as lawmakers.

 

NOTAis the spark that will give our frustration a peaceful outlet. A non-violent strategy is the only way to translate NOTAinto a voter’s democratic ‘Right to Reject and Recall’. Now is the time for us all to mobilize public opinion and together peacefully reach our goal for a better tomorrow.
