On October 17th, 2012, while making a left turn, my car was rear-ended by a clearly distracted, speeding driver of a large pick-up truck, who hit me so hard my knees slammed into the dashboard,my car spun around, and by the time it stopped, I was facing the opposite direction. I heard the rear windshield shatter, metal twisting, and saw pieces of my car careen across the road. The driver's seat partially dislodged and reclined to a 45-degree angle. My beloved little blue 1999 Suzuki Esteem, which had a great deal of sentimental value, was destroyed. The man who hit me came over to me and inappropriately started accusing me of not having my blinker on, which was untrue. When the EMTs came, my blood pressure was 200/100. I am low-income, on Social Security, food stamps, and housing vouchers to survive, and now my only form of transportation is destroyed. It is common knowledge that Japanese engines last 200,000-300,000 miles and my Suzuki had about 140,000 miles and would have probably lasted me the rest of my life.
As many people are already aware who have had auto accidents, the insurance industry spends billions on tasteless advertising campaigns, but when we have accidents and need our claims paid timely, need insurance companies who have gladly collected our premiums to make good on their contractual obligations, they suddenly turn from Jekyll to Hyde.
I am insured with AARP-The Hartford for auto insurance and have been for many years. The at-fault driver is insured with Progressive. Both insurance companies treated me from the minute I first filed the claim, like something on the bottom of their shoes.
Their first manipulative tactic is try to get accident victims to only speak to them verbally on the phone or in person. NEVER DO THIS. Insist on e-mail communication, and if they refuse, immediately file complaints with your state's Office of Insurance Commissioner, which I did, as a resident of Washington State, and from then on, of course, the acts of retaliation began and not only still continue, but have grossly escalated.
Even though Japanese engines are of such proven longevity, neither Hartford nor Progressive would offer me more than a mere pittance for my vehicle, and because I am low-income, I cannot afford car payments, nor can I be approved for a car loan without a huge down payment. The Hartford stopped paying for the rental vehicle, so I am now without transportation to medical appointments, pharmacies, grocery shopping, etc.
The Hartford is contractually obligated to reimburse me for "essential services," such as taxi fares and house cleaning assistance, which I can't afford to pay upfront, and Hartford refuses to pay out the $5,000 in essential services I'm entitled to upfront--which they could do if they wanted--knowing full well that I'm low-income on Social Security, but they stubbornly refuse.
As far as personal injury attorneys are concerned, my experience with them has been just as bad or worse as with the insurance companies themselves. Many of you may or may not know that what personal injury attorneys basically do is negotiate "sweetheart deals" with the insurance companies, negotiating one case against another--and who loses--the accident victim/client that gets the short end of the stick, plus the fact that the personal injury attorneys I've ever been involved with are rude, disrespectful, dishonest, and verbally abusive, both to their clients and their staff, which I've witnessed for myself.
Therefore, though I'm injured, in pain, and without transportation (and I cannot utilize public transportation without risk of infection, as I have hypogammaglobulinemia, which is low Ig levels--immunoglobulin--for which I'm currently not receiving infusion--a condition which puts sufferers at high risk of infection and is aggravated by stress, such as the stress of this accident, plus the unnecessary stress caused me by both Hartford and Progressive), as I cannot even bend over to tie my shoes without pain, still both insurance companies, particularly The Hartford at this point, continue to retaliate against me by refusing to pay my claims and dysfunctionally try to force me to only communicate with one (weird, creepy) person there, which I will not agree to, nor should anyone else, should you ever be coerced by an insurane company to do so.
And another manipulative tactic insurance companies try to get away with is by trying to convince victims that the PIP is supposed to be reimbursed to them out of the other company's Bodily Injury. THIS IS COMPLETELY UNTRUE! The Bodily Injury is NOT a bank account for the insurance companies to pay themselves back out of, and they collude with each other to try to make this happen.The PIP and the Bodily Injury are for the injured party's medical bills and pain and suffering, and since my medical bills have already maxed the PIP, and I have proven repeatedly to Progressive that the Bodily Injury will be--and is already in the process of being--repleted, as well, that Hartford is justified in paying out my $25,000 UM, but they won't even pay out my eseential services, and continue to threaten, inappropriately accuse me, and try to silence me, which "ain't gonna happen."
What Hartford doesn't seem to get--not now, nor five years ago--is how to diffuse a situation rather than further inflame it--but by having Meggan Conner send me a threatening letter, and by having Chris Chase, creepily try to convince me to only communicate with him, that's exactly what they're doing--deliberately throwing oil on the fire, which is low-mentality, lazy thinking, completely bereft of communication skills, negoatiating skills, diplomacy, as well as completely bereft of human compassion.
Once I filed OIC complaints, both Hartford and Progressive began communicating with me via e-mail, but in an uncooperative, vindictive, and retaliatory manner. I complained to both their corporate offices, who only further retaliated by deliberately slowing down the processing of my claims to a snail's pace, inappropriately ordering the adjusters to not communicate with me, so the corporate offices could deliberately slow down the handling of my claim.
Chris Chase has taken this abuse to a whole new level. He keeps sending me e-mails--like he's the boss of me or something--ordering me to only communicate with him--which is very creepy, dysfunctional, extremely inappropriate, and downright abusive. He went on Thanksgiving vacation, ordered no one else at Hartford to respond to me or pay out anything to me, and then when he returned, he lied in an e-mail and claimed he'd only been out one day. Every time these incidents happen, I immediately inform OIC, but Hartford continues to treat me worse and worse, and now, one of their Consumer Affairs employees, Meggan Conner, wrote me a threatening, abusive letter, accusing ME of being abusive (that's their standard modus operandi--lamely accuse the victim of being abusive to draw attention away from their OWN abusive and retaliatory behavior).
I may be low-income, and rely on Social Security, food stamps, and housing vouchers to survive, but I will NOT remain silent and be dictated to by an insurance company, to whom I can and cannot communicate with, and I have e-mailed Hartford repeatedly, informing them in no uncertain terms that I will not accept this behavior or continue to be treated like a doormat by them.
Not only that, but I recently learned that Hartford has been scamming policy holders with regard to Underinsured Motorists insurance. They falsely claimed I have $10,000 in UM, when in actuality, I have $25,000, which of course they refuse to pay out, in spite of the fact that I desperately need it. This also means that five years ago when I lived in Florida, Hartford cheated me out of $15,000 UM following an auto accident that left me homeless, living in a motel for nine months while fighting with the insurance companies involved at that time (GEICO and Hartford) for my benefits.
Now, five years later, the very same thing is happening, which clearly indicates, as many of you are aware, that the insurance industry in this country has been and continues to get away with murder. Instead of spending billions of dollars on tasteless advertising, they should be spending that money on their policy holders, but instead they pay their CEOs obscenely large salaries, which attests to their arrogance and lack of concern and compassion for the health and welfare of their customers. THIS MUST STOP.
The insurance industry is actually the guilty party at fault for the demise of the middle class in this country, as they continue to gouge American companies more and more for group health and worker's comp premiums, to the point where companies/corporations (rather than stand up to the insurance industry themselves), sent American jobs overseas (which never should have been legal to begin with), but nevertheless, the result is the same--the destruction of the middle class--and STILL--no one stands up to the insurance industry because they continue to bribe politicians in the form of campaign contributions (which should also be illegal, as should superpacs), so it is up to us--people like you and me who have been repeatedly and unjustly abused by insurance companies--to speak out about this and insist on change and accountability. (And if we had universal healthcare in this country, this would not have happened...but WHO benefits from private and group health insurance and worker's comp insurance--the insurance industry and no one else).
I am asking all of you to help me in this endeavor by e-mailing the President and legislators at both State and Federal levels, insisting on massive insurance industry reform, and to please help me receive my benefits so I can survive, by e-mailing The Hartford staff, and insist they immediately cease and desist from dysfunctionally and creepily insisting I communicate solely with Chris Chase, insist the adjuster, Erin Trimmer and her supervisor, Karin Stoner, communicate with me directly and immediately pay out my essential services and UM, immediately insist Meggan Conner cease and desist from sending me threatening letters and ordering me to communicate only with her (regarding the fact that Hartford tried to get me to continue paying monthly premiums for a vehicle I no longer have, threatening to charge me higher fees at some future date when I procure another vehicle), immediately pay out my $5,000 in essential services so I have money for taxi fares and house cleaning services ordered by my physician, immediately pay out my $25,000 in UM, and pay out the $15,000 in UM they cheated me out of in 2007.
I am injured and in pain and without transportation, as a direct result of being treated abusively by the insurance companies, particularly The Hartford. I have complained to OIC and AARP, to no avail. I have a torn meniscus which may require surgery, and I cannot stand or walk for very long without pain. I have asthma and a weakened immune system, all of which are exacerbated by the unnecessary stress heaped upon me by The Hartford and Progressive.
It's time for us to stand up to the insurance industry and insist on strong legislation protecting consumers instead of the insurance industry, as well as strong, prompt enforcement and penalties.
