Please sign this petition in support of David Macneill being granted a travel restriction exemption on compassionate grounds.  

David is fully vaccinated (Pfizer), has a ticket booked for 12 July, and a valid visa (pending travel exemption). He is desperate to be allowed to come from Canada to Australia for 3 months to care for Juliet through the rest of her cancer treatment.  

David’s wife, Juliet Wilson, was diagnosed on New Years’ Eve with aggressive, fast-growing, Stage 3 breast cancer, that has spread to her lymph nodes. Treatment requires six months of chemotherapy, a double mastectomy, removal of her lymph nodes, and radiation therapy. With her family and husband in Canada, it has been very difficult for Juliet to cope with the last six months of chemotherapy on her own, and when she found out that following her surgery, she would not be able to lift her arms or do very much for herself, she was completely overwhelmed.  

Juliet does not have anyone who can move in and care for her during her 4-6 week recovery. As well, due to the significant permanent change to her body, and personal nature of her post-op care, her husband is the only person suitable to provide this support she will need as she confronts the physical and emotional effects of her surgery, and the rest of her treatment. 

David and Juliet both grew up on Prince Edward Island in eastern Canada. (Juliet moved to Melbourne in 1992 and has been an Australian citizen for more than 25 years.) They developed a close friendship over many years after reconnecting as adults, and finally started their romantic relationship in July 2019 on one of Juliet’s trips home. David then came to Australia in early 2020, and they made plans for their future. Unfortunately, when COVID-19, they were stuck on opposite sides of the world. With no other choice, they married in a legally recognised virtual ceremony on May 31. Their marriage was the natural progression of their long-term, exclusive relationship, and a further step towards their long-term plan for David to relocate to Melbourne when circumstances allow. 

David and Juliet have sought a travel restriction exemption on two grounds – with David as a direct family member, and on compassionate grounds. The Australian Border Force (ABF) have confirmed that immediate family members were exempt from travel restrictions. They also confirmed that requests could be considered on a case-by-case basis in compelling circumstances. 

Despite this, and despite their lawyer addressing concerns about the legality of their video conference wedding in the fourth application, their fourth application was rejected last week. Their lawyer has sought a review of that application on the basis that the compelling and compassionate circumstances criteria had not been assessed. 

Time is running out. With only a week until David’s flight, they are appealing to the Dept of Home Affairs to grant their travel restriction exemption on compassionate grounds. Please help them by showing your support for their situation.
