Abolish Mandatory payment of Service Charge at Restaurants

My brother and I had been to this restaurant named CONNIE'S STEAKHOUSE AND WINE BAR in Kammanhalli, Bangalore on January 7, 2017 and after dining in we noticed that our bill carried an exorbitant rate of service charge of 10%! This came as a bit of a surprise to notice that such reputed restaurants were charging such high Service Charge rates and that too after the recent notice issued by the Centre and by The Department of Consumer Affairs which stated that payment of Service charges was completely up to the customer.

The non-compulsory nature of the Service charge is well known to both the Hotel Association as well as the restaurant owners, and I have had restaurants politely waive off Service charges for me before, upon request.

However the owner of CONNIES'S was extremely adamant in forcing this payment upon us even after a good 30-40 minutes of discussion. His argument was that it was pre-mentioned in the Menu (where he had just mentioned that taxes and charges would be levied, but the %age had been conveniently omitted). He also stressed that the Govt. never passed a law stating that it was 'NOT COMPULSORY' to pay these charges. This makes absolutely no sense since the Govt. never suggested that Service charges be levied in the first place and the Restaurant Owners are never the Lords to decide it so arbitrarily.
