In California, tickets to live concerts and sporting events are not subject to state sales tax. Under a new proposal, AB-2540, tickets to live theatre performances would be taxed...not movies, live concerts or sporting events, just live theatre performances.

Why is it important to pay state sales tax to attend your child's non-profit school play (if admission is charged) while Lakers season tickets and Hollywood Bowl performances are sales tax free? I really don't know. What I do know is that Assembly member Gatto's proposal draws a pall over both for-profit and non-profit theatre companies in California.

Clearly, somebody doesn't like what is being presented in live theatres in California. That is their right. What isn't right is for live theatres to be singled out for taxation while other types of entertainment are given a walk.

The live theatre community creates jobs for thousands of Californians directly, and indirectly for hundreds of thousands more. If tickets to live shows must be classified as part of the "tangible" service economy, so be it. But then it is only equitable to include movie tickets, theme park tickets, and tickets to live music and live sports events in the same category. Singling out live theatrical events sounds, well, un-American...doesn't it?
