House Bill 2166 imposes a tax on all Arizona Drivers that was not agreed upon by the proper channels within state legislation. As put by Robert Robb with AZ Central: "Next time you register a vehicle, you will pay $32 for what will be called a “public safety fee.” Arizona Supreme Court Chief Justice Scott Bales and Gov. Doug Ducey imposed this fee through the state DMV as a public safety fee that forces drivers to pay the $32 per vehicle per year regardless of income.

The fee is new and will raise an estimated $185 million a year. However, in 1992, voters adopted a state constitutional amendment, Proposition 108, requiring that any law that increased state revenues be approved by a two-thirds vote of both chambers of the Legislature.

Prop 108 included any new administratively set fee...."

Prop 108 should include House Bill 2166.

Justice Bales has been criticized about creating this loophole due to lawmakers denying previous Medicaid and hospital taxes that he wanted to introduce previously.

Due to Prop 108 being in law, the fee/tax was introduced through the state Department of Motor Vehicle, which does not require a 2/3 majority vote, and sticks drivers with the bill.

Take for example: If a person was to drive a vehicle older than 1996 and renew for a 5 year registration, the registration costs could be expected to be around $65-$150. The DMV's safety fee would stuck-on an extra $160 to the cost bringing to between $265 -$300 for their registration costs. These costs can grow substantially if a newer vehicle is registered, or if an owner has multiple vehicles. Not only was the original price doubled (as the fee was initially introduced to be about $18 per vehicle, per year) but it has been forced on the population without proper due process, and deliberation with the proper parties required to tax the population.
