The Transgender Persons (Protection of Rights) Act, 2019 is an act of the Parliament of India with the objective to provide protection of rights of transgender people, their welfare, and other related matters.

This bill claims to give transgender people a 'right to self-perceived identity' — but requires them to register and submit proof of gender confirmation surgery to the government to be legally recognized as transgender.

Following protests against the 2016 and 2018 bills, the 2019 act has done away with few of the severely criticised provisions, such as the criminalisation of begging and the establishment of a district screening committee to process applications for issuance of transgender person certificates. However, it still fails to incorporate a lot of other principles as listed in the Supreme Court judgment- such as the right of transgender people to declare their self-perceived gender identity without undergoing sex reassignment surgery, and reservations in jobs and educational institutions. The act has also been criticised for imposing less punishment for crimes against transgender people compared with punishment for crimes against cisgender people.

It also fails to mention civil rights like marriage, adoption, social security benefits and also does not provide quotas for transgender people in public education and jobs — something that the Supreme Court's 2014 ruling had directed the government to do.

 Needless to say, the bill is draconian and discriminatory. It invalidates gender affirmation without surgical procedures and clearly implies that the abuse of a Trans person is a lesser crime than the abuse of a cisgender person.

It’s no secret that life is already pretty difficult for the transgender community in India. They have to face stigmatization, harassment and systemic exclusion from educational and employment opportunities on a daily basis. As a result, a lot of these people feel they have no alternative but to turn to sex work; HIV prevalence among India's transgender community is 26 times higher than the national rate. But it's difficult for them to even get access to basic health care without facing discrimination. Trans individuals also face disproportionate public violence and police brutalities.

So, let’s try and do our bit to try and make things just the tiniest bit better for them.

By signing this petition, we ask for:-

1. The right to declare our gender identity without requiring sex reassignment surgery for legalities.

2. No discrimination between cisgender and transgender people, especially when it comes to the law and the penal code.

3. Access to proper healthcare to be given to the Transgender community.
