Pepper spray is a valuable tool for people to defend themselves in a non lethal manner aginst humans and animals. Here in TX however the law is vague stating one can only have a "small commercially available" pepper spray. Yet this law says nothing about what is considered small so people get stuck with tiny keychain units that are inadequate or risk a felony charge. A hiker worried about bears under Texas law also has to worry if his 9 oz can of bear spray is legal. An old lady who can't handle the recoil of a firearm now has to worry if her 13oz can of OC she keeps for self defense is illegal. A woman worried about her ex and his buddy attacking her also has to worry if the 4 oz can she has in her purse is legal or not. All of those cans seem large when compared to a 0.5 oz keychain can but they seem small compared to the kind police use during riots. With people being able to legally carry firearms now with no permit it would only make sense to let them carry OC spray without worry so they have a less lethal option. With this confusing law we will see more people turn to lethal force in situations that could have been solved with less lethal OC before they escalated to a lethal encounter. The purpose of this petition is to get the Texas legislators to either define what is legal by volume of allowed OC spray in a canister and or to unrestrict OC spray all together.
