Beware my fellow Realtors. Castle Rock just terminated a contract for my young couple that saved for ever, put in $6500 towards their dream home and then due to the tightening up of FHA loans and backed up appraisals we didn't hit our close date so they terminated our contract. Their offer to us was that they would allow us to continue but would have to pay the new base price...since May 2020 it is now $42,000 more. My buyers can not qualify for that. I even offered my entire commission. They said NO. They are going to resale it for $42K more, keep their $5000 that they put in to the upgrades that the builder is now benefiting from. Extortion, unethical, just plain NOT right. Now my couple with their 3 year old toddler (birthday yesterday when the builder terminated) are homeless and out $5000. They did offer them back their $1500 earnest at least. I even offered the Builder to take my entire commission to extend until next Friday - they said no.

Remember 98% of the builder contracts are written to heavily protect the builder(we get that). A good amount of them try to force your buyers to use their lenders for incentives (even though they do not have the best rates or programs and most of that money is used to buy down rates, etc), and they will not work with the consumer even under reasonable circumstances. By the way my buyers did everything right, they are fully approved now, but due to having to go back into final underwriting and the 3 day requirement to present the CD to the buyer, plus FHA came up with tighter requirements, plus the back up on appraisals added to the delay, still not my buyers fault. This is just sickening. First contract that has not closed for my buyers. Castle Rock upper management either passed the buck to someone else or they just plain said NO to an extension.
