The use of handheld wireless communication devices has blossomed in recent years. Using a handheld wireless communication device when operating a motor vehicle is irresponsible driver distraction. Operator distraction is a major threat to the motoring public and especially to motorcyclists. 2018 has seen carnage visited upon the motorcycling population in our state of Utah.

WE, THE UNDERSIGNED, PROPOSE TO CHANGE UTAH CODE TO REFLECT THE FOLLOWING:

1.           A person may not hold in their hand a wireless communication device while operating a moving motor vehicle on a highway.

a.   Unless:

                                          i.    during a medical emergency;

                                        ii.    when reporting a safety hazard or requesting assistance relating to a safety hazard;

                                       iii.    when reporting criminal activity or requesting assistance relating to a criminal activity; and,

                                      iv.    when reporting a safety hazard or requesting assistance relating to a safety hazard;

                                        v.    when used by a law enforcement officer or emergency service personnel acting within the course and scope of the law enforcement officer's or emergency service personnel's employment;

                                      vi.    to operate hands-free or voice-operated technology from a system that is physically or electronically integrated into the motor vehicle

2.  A person convicted of a violation of this section is guilty of a:

(a)   a class B misdemeanor with a maximum fine of $1,000; or

(b)   a class A misdemeanor for a second offense with a maximum fine of $2,500;

(c)   a second degree felony for a third offense or the person inflicted serious bodily injury upon another as a proximate result of using a handheld wireless communication device in violation of this section while operating a moving motor vehicle on a highway in this state with a possible prison term of one to 15 years in prison with a maximum fine of $10,000, or

(d) a first-degree felony if the person causes death as a proximate result of using a handheld wireless communication device in violation of this section while operating a moving motor vehicle on a highway in this state with a possible prison term of five years to life in prison with a maximum fine of $10,00
