John Michael Smith at the age of 18 was in the wrong place, in a bad state extremely high on a combination of drugs, at the wrong time with the wrong person. At a drug dealer's house wandering around the yard, he heard a yell "run" and did followed by 3 gun shots. He went back to see his "friend" covered in blood struggling with the dealer. He cried out "help me Michael". The dealer would have died from the first 3 shots fired. Unfortunately in his mind defending his friend, he fired a shot. He had no defense with a public defender who had a brief paragraph for an opening statement. Also he was the only witness called. The attorney was chairing his second murder case with an 18 year old with no record in a complex case with no time or resources. He deserves another opportunity. We are filing an application for commutation to shorten his sentence.
