Subject : Regarding a clear cut violation of fundamental Rights to Education as well as Rights to Privacy under Article 21 of the Constitution.

Us, first year students from KIMS college of nursing Trivandrum are prohibited from using mobile phones or any other digital devices in the hostel/hostel premises with effect from 7th of nov 2021. As you might know, the academic year of 2021-22 kick started via digital platforms. All the study materials provided by college were soft copies and e-modules which we have very limited access as of now. Let us please bring your attention towards the observation of honorable justice PV Asha while ordering the Principal of Sree Narayana Guru College, Kozhikode to re-admit Faheema Shirin RK, 3rd semester BA English student of the college, who had been expelled from the college hostel for using mobile phone beyond the restricted hours in 2019. The court made it clear that any enforcement of discipline should not block the ways and means by which students acquire knowledge. We tried to negotiate with the hostel management amidst this particular situation and failed many times. We stay in this "bio-bubble" staying away from our dear ones, we used to balance our trauma by meeting them virtually atleast. This restrictions has caused serious mental stress and imbalance in our personal lives. Requesting you to look into this situation and resolve this issue with any possible litigations.
