Urban Renewal should not require property owners to forfeit their Constitutional Rights nor legal protection granted by their state of residence for a municipalities economic development or tax revenue enhancement.
The property owners of the Welton Corridor in Denver, Colorado need your support to help protect our property rights from Denver Urban Renewal Authority's unnecessary regulations and increased power of eminent domain.
Our Property Rights are Our Civil Rights
Eminent Domain, also known as condemnation, originally was used only for public projects such as roads and schools. Currently urban renewal agencies routinely condemn on behalf of private developers and then provide tax incentives and subsidies to those developing these “blighted” areas.
This controversial practice has generated considerable litigation and publicity in recent years. Issues arising from eminent domain abuse include the legality of the “blighting,” challenges to the alleged “public” purpose and the amount of compensation the property owner is given at the time of the taking.
If Denver City Council approves the Welton Corridor URA proposal on 10 September 2012 then DURA’s permission to evoke eminent domain will be expanded to allow for the transfer of property to a private individual for tax incentive and municipal economic gain. (link to document)
This is in violation of Colorado law enacted by the passage of House Bill 06-1411 which requires the condemning entity to demonstrate that the taking of the property is for a public use. This law also precludes the taking of private property for transfer to a private entity for the purpose of economic development or tax revenue enhancement.
Time is of the essence: If Denver City Council approves the Welton Corridor URA proposal on September 10, 2012, the property owners will no longer be protected by the ‘Takings Clause’ of the Fifth Amendment, Colorado House Bill 06-1411 and other crucial property rights.
Property owners must contact their elected officials RIGHT NOW in order to preserve the future of their property rights and our community.

I believe in the Welton Corridor's growth, prosperity and sustainability but, this proposal does not support the long term best interests of the Welton Street community because:
+ It’s implementation will rely on tax increment financing. This will remove property and sales tax dollars from our existing Denver infrastructure of schools, libraries and safety resources.
+ DURA’s proposal does not identify a developer nor an anchor project that will serve to instigate growth along the corridor.
+ There is no master plan addressing Welton Street from 20th to Downing Street resulting in a proposal with goals that are vague in scope, cost and neighborhood impact.
+ DURA requires the property owners to engage in a 25 year legal contract permitting DURA’s use of eminent domain to transfer property to a private individual for tax incentive and municipal economic gain. This is in violation of Colorado Laws enacted by the passage of House Bill 06-1411 which requires the condemning entity to demonstrate that the taking of the property is for a public use and precludes the taking of private property for transfer to a private entity for the purpose of economic development or tax revenue enhancement.
DURA has not provided a compelling reason require the Welton Street property owners be legally bound to a document that holds the saber of eminent domain over their property rights for the next 25 years.
I request that you DO NOT APPROVE DURA’s proposal.
