If you live in a single-family zoned area (an area that does not allow condominiums, hotels, motels.... or any type of commercial business) and you do not have a Home Owners Association (HOA) your zoning rights have been taken away.
In the summer of 2016, the passage of ARS9.500.39 (non-home owner short term rentals) was signed into law by Governor Ducey. It has re-zoned the single family area without neighborhood consent and with total disregard for the Arizona Constitution Article 13, Section 2 which gave the Cities the right to enforce their own charters and write their own zoning laws.
Not only are non-homeowner short term rentals now allowed in single family zoned areas but now there is no occupancy restrictions in these short term rental homes - meaning a home can be rented out to an unlimited number of people on a weekly basis.
Many are owned by out of state corporations and are advertised on Airbnb, VRBO to accommodate 14 to 30 people and many also advertise parties can be held with well over 100 people showing up. This is dangerous....
I contacted the Arizona Attorney General Office and asked them to review the legality of ARS9.500.39 but it requires a legislature to question the law under Senate Bill 1487.
