Withdraw Immunity Bill - Tabled By Rajasthan Government

Dear Friends,

Rajasthan government has recently tabled a bill accordingly to which no investigations could be carried out on any of the public servants or Magistrate or Judge and media is also forbidden to take name of such public servant till the Rajasthan government allows the case to be investigated. It says

"Provided that, under the aforesaid sub-section, no Magistrate shall order an investigation nor will any investigation be conducted against a person, who is or was a Judge or a Magistrate or a public servant, as defined under any other law for the time being in force, in respect of the act done by them while acting or purporting to act in the discharge of their official duties, except with previous sanction under section 197 of the Code of Criminal Procedure, 1973 (Act No. 2 of 1974) or under any other law for the time being in force

Provided also that no one shall print or publish or publicize in any manner the name, address, photograph, family details, or any other particulars which may lead to disclosure of identity of a Judge or Magistrate or a public servant against whom any proceeding under this section is pending, until the sanction as aforesaid has been or deemed to have been issued."

Generally we get to know about such incidences from Media only and if Media is forbidden to do anything, then poor residents would never ever be able to resolve the issues and justice will be denied forever. 

If this bill is passed and approved, it will be death of democracy. It will result in further increase in corruption and lack of transparency into the government system. It will be death of fundamental rights of residents. Why such autocratic approach. Instead they should be encouraging people to come forward and report such case and bring it to highlight so that non-influential people like you and me can also think of getting justice. If they feel that these are allegations, let the judiciary decide that. Rajasthan Government has no right to decide whether an allegation is worthwhile to pursue or not.
