 The number of matrimonial disputes in India during the past decade is alarming.As per NCRB report the number of matrimonial disputes in Indian courts account for 52% of total number of litigations across the country. A large majority of such litigations include children born out of the wedlock,these special children undergo a silent suffering during their childhood and are deprived of love and affection of the non-custodial parent and are used as tools of vengeance. It is the right of every child maintain bonding with both parent and lack of it can have serious effects on a child’s mind. Parental alienation to children at young age happens to be a major factors behind serious crimes could result in drug abuse, deteriorating educational achievement, premature sexuality, mental/personality disorder, chronic depression, suicidal tendency, out of wed-lock birth.

 Every child has a fundamental right to maintain un-threatened and loving relationship with both parents, and to be denied that right by one parent, without sufficient justification such as abuse or neglect, is in itself a form of child abuse.An application for child visitation are intentionally dragged and the court orders can be conveniently violated since there are no stringent laws or provisions to govern visitation rights and punish the offenders in India.
