Our fight has not ended, The Supreme Court recently dismissed a review petition seeking various civil rights for LGBTQ people of the country, including same-sex marriage, adoption and surrogacy rights. The bench headed by Chief Justice Rajan Gogoi and comprising Justices Deepak Gupta and Sanjiv Khanna declared “We are not inclined to entertain this petition after the decision of this Court in Navtej Singh Johar v Union of India decided on September 6, 2018,” The petition sought legal recognition for same-sex marriages, adoption, surrogacy and IVF. This dismiss yet again proved that the right of the LGBTQIA community are not seen as human rights but are regarded as privileges.
Till date same sex marriage is not recognised in India and there are no options available for adoption, surrogacy or IVF for LGBTQIA community. Queer citizens still can't serve in the Army, Navy or Air Force.
Decriminalisation of 377 has clearly initiated a change for equality in India but there is still a long way to complete acceptance.
· We demand for Legal recognition and protection to samesex couples by amending Special Marriage Act, 1954We demand to withdraw the proposed prohibition onsurrogacy of same sex couples under the surrogacy bill.
· We demand a comprehensive adoption and inheritance bill.We demand a legal framework to safeguard same sexcouples from discrimination, honour killings and other hatecrimes.
We demand the supreme court to take up this issue seriously and to give a comprehensive inclusive ruling to grant true equality to individuals.
