Marc Fishman, a 46 year old disabled father with post concussion syndrome, was illegally detained and arrested on December 15, 2018.  Marc was arrested by Westchester New York  Police while attempting to have his bi-monthly Family court ordered supervised visits with his four children  and supervising social worker every other Saturday.  

Marc was arrested in the presence of his court ordered supervisor because the police stated his visitation order, signed by a judge, was invalid and not in effect.  The Westchester New York police informed Mr Fishman that his court ordered visitation order was not valid because it was not personally served on him.  Marc had visitation with the same supervisor for over 10 months on alternate weekends and the supervised visitation order was entered in Westchester court and served on Mr. Fishman’s attorney.

 The police checked off the box Marked “unknown” on the arrest report in response to the question “Was a visitation/probation supervisor present?”  The police purposely violated Mr. Fishman civil rights because they knew the supervisor was valid, legitimate and court ordered.  The Westchester New York police violated Mr Fishman’s civil rights by arresting him for violating a family court order of protection in favor of his ex-wife.  The police ignored and disregarded the court ordered supervised visitation order for Saturday visits from Ten am to five pm. The police just stated Mr Fishman was being arrested for being near his ex-wife in violation of an order of protection while he was with the court supervising social worker in the process of picking up the four children. The pickup was at the beginning of the court order visitation time of ten am to five pm on Saturdays.

Marc Fishman has supervised visitation because the Westchester Family court believes His memory disabilities from two car accidents prevent him from successfully parenting his four children.  Marc Fishman is a loving, caring and attentive dad of four adorable children.  Marc’s kids are Twin boys Aidan and Skye ages 10,  son Jonah age 13, and daughter Joanna age 15. Parents with disabilities like Marc  face steep challenges and disability discrimination in the family court system as detailed in the Report, “ Rocking the Cradle, Ensuring the Rights of Parents with Disabilities and their Children” prepared by Robyn Powell , National Council on Disabilities, and the Christopher Reeve Foundation.

Please sign this petition to stop the malicious prosecution and violation of civil rights of disabled dads including Marc Fishman.  Please encourage Judge Warhit in White Plains Court to dismiss the proceeding and restore visitation with his children.  Thank you.
