Hi Salem Creek Community,
My family is currently going through an unfortunate situation regarding the aluminum fence that was recently installed in our back yard on the corner of Presley Drive and Earline Way. My wife and I went through the proper submission process, and Carrie Snow of PSMT gave us parameters for the fence location.
On the date of installation, the fence contractor pointed out that a Comcast cable line would run directly underneath the front corner of our fence, so I gave them permission to extend out the fence a safe digging distance (36 inches) to avoid damaging the utility while also protecting the gate and panel from collisions.
I made an assumption this would not present an issue since the fence would still meet the required distance from the sidewalk (>20 ft away at that point). Additionally, our fence is further away from the sidewalk than 2 previously approved existing corner lot fences in our neighborhood. The fence location is also within the parameters of our permit from the City of Murfreesboro.
Unfortunately, the ARC determined my fence must be moved back to their preferred location (~$1,000 expense), or my family will face legal action. Desperately wanting to avoid this, I quickly reached out to Carrie Snow to request a simple meeting or call with the ARC members to explain why the gate was moved and express my willingness to explore any potential alternatives to remedy their concerns.
My request to speak with them was unfortunately denied, so I spent hours putting together a detailed presentation (click here to view) explaining why the fence was moved, sincerely apologizing for the error, and offering to plant trees/flowers/shrubs in front of the fence as a remedy. This was also denied, and instead, I was instructed to move the fence within 30 days or again face legal action.
Ultimately, I understand that the fence is not within the exact parameters put in place by the ARC, and they have the contractual right to exercise their power. What I continue to find confusing and discouraging is the inconsistent and somewhat arbitrary restrictions on what is approved and what is not.
Additionally, my wife and I have felt quite vilified during the entire process as opposed to being treated like a fellow neighbor. I do want to point out though that ARC decisions are based upon a vote, and do not necessarily represent the opinions of all members. I want to express sincere gratitude to the member who was kind, helpful, and compassionate to us during the process.
This petition very well make zero difference in the outcome of this situation, but I do feel it is necessary to at least bring awareness. My wife and I will of course work to save up the $1,000 to move the fence and avoid the crippling costs we would face in legal fees. I have already contacted the fence contractor to discuss the move, but I owe it to my family to at least heave up one final desperation Hail Mary.
If you feel that the current location of our family's fence upholds the aesthetic and safety standards of our community, and you do not wish for Property Management Solutions of Middle Tennessee to seek legal action against our family, we would sincerely appreciate your signature on this petition.
