Reinstate the Summerfield Covenants Committee & Restore Reason to Code Enforcement
Signing this petition will signal to our Board of Directors that we, the homeowners of Summerfield, recognize that the current practice of Board members acting as the Covenants Committee is a violation of our covenants and right to appeal.
The goal is simple: Until a covenants committee of non-board members is in place, all violation notices, fines and actions against homeowners must cease.
This will ensure that homeowners are restored their covenant-given right to an appeal and will prevent costly and hurtful lawsuits against our association.
The current Board of Directors is not operating according to the covenants they claim to be enforcing.
Article XIII c states, “Following a hearing before the Covenants Committee, the violator shall have the right to appeal the decision to the Board of Directors.” No such covenants committee exists. Until it does, you the homeowner have no one to appeal to when unreasonable decisions are made that cost you fines and other expenses to remedy.
If you have received a violation notice, which should be coming from the Covenants Committee, it is actually coming from the Board of Directors. Again, the Covenants state that you should have a right to appeal to the Board of Directors if you don’t agree with a decision of the Covenants Committee. How can you do that if they are one and the same?
