The local Parish Council has applied for a public footpath to go through our xc course.We are forced to oppose this application. Not because we don’t like people walking on our land, but because:
This is the ONLY track that allows us to run a circular xc course route at competitions – clearly mixing the public with a 600 kg horse travelling at 30mph is a dangerous prospect!
The xc course represents a major part of our business – we run a very serious risk of business failure if this was to be allowed. As a long standing local business that has contributed £1000’s to local charity every year, employs and trains local people, and brings business to local pubs, shops and B&Bs, as well as a family business supporting staff and owners alike, we think the area will be the poorer for it. We are fighting a real threat to our business survival.
The path in question has NEVER been a public path – as proven by maps of the local area.
Section 31 of the Highways Act 1980 states ‘it is necessary to show firstly that there has been UNINTERRUPTED use as of right by the public’ – This is clearly NOT the case as the path is most definitely closed to the general public on competition days (such as March Trials).
Furthermore, the landowner must have ‘intended to dedicate the path to the public as a right of way’ – our signs and locked gate clearly indicate that this is not the case.
As a landowner, we can clearly prove that there was no intention to dedicate the way as a public right of way.

“I herewith declare that I am aware that the path shown on the map above is not, and has never been intended to be used as, a public right of way. As a competitor / rider / client / visitor to Poplar Park Equestrian Centre it has been clear to me that I have access to this path only by permission of the landowner or as a paying guest.”
