
🚨 IMPORTANT PETITION UPDATE 🚨
The Town of Hamburg Planning Board is preparing to issue a Negative SEQR Declaration and approve the proposed 6-building warehouse/shop project at 3401 & 0 Lakeshore Road.
If approved, this would mean the Board has determined that a project exceeding 75,000 square feet — located near Rush Creek, residential neighborhoods, and critical infrastructure — will have no significant environmental impacts requiring a full Environmental Impact Statement (EIS).
Many residents strongly disagree.
Serious concerns remain regarding:
• Flooding and stormwater runoff
• Rush Creek and surrounding environmental impacts
• Sewer infrastructure access and capacity
• Heavy truck traffic near homes and local roads
• Loss of natural buffers and neighborhood character
• Contradictions and unanswered questions within project filings and review documents
Residents have repeatedly raised these issues throughout the public review process, yet many concerns remain unresolved as the project moves toward approval.
Community members are now preparing to explore all legal options available under New York law, including a potential Article 78 proceeding, which allows courts to review whether a municipal board acted arbitrarily, improperly, or without sufficient environmental review under SEQR requirements.
