STOP PHYSICIANS FROM PRACTICING WITH IMPAIRED THINKING-COGNITIVE DYSFUNCTION

To change the ruling. we need 124,000 signatures in Colorado alone and as many signatures from everywhere in support of this change.

 

NO ONE WANTS A DOCTOR WHO IS IMPAIRED IN THEIR THINKING TO BE TREATING THEM FOR ANYTHING.

Physicians are required to self -report their condition within 30 days to the medical board, failure to do so is considered unprofessional conduct. We know now ours did not as we were not aware of her impairment until months after the medication was prescribed and when it was too late for Natasha. This physician treated Natasha causing a severe life-threatening health decline by prescribing the wrong medication at too strong a dose.

It has been 4 years since this physician has taken away Natasha’s ability to live life and create life. It took calling all the lawyers in Colorado to get this case against a doctor who was practicing with cognitive dysfunction/impaired thinking.  Which she admitted to us after it was too late and this doctor never turned herself in.

The lawyer that took us on said we had a very good case, having her on record admitting what she had prescribed Natasha was the reason for her severe and life-threatening health decline.

Our medical bills because of this physician’s negligence are $6,000 out of pocket each month. It has already been 2 years since the date of the filing and 4 years since the negligence. By the time we get to trial it will be five and a half years since the negligence all the time suffering from the added cost caused by this physician.

It has been 4 years now and we must wait an additional 17 months until trial and our only recourse to stay alive and paying her medical bills is to ask for charity and donations.  

We are petitioning for these changes to be added to help stop physicians from practicing with impaired thinking.  Right now, the rules are too lenient letting doctors who can beat the testing go right back into practice.  We need a change.

In Medical Malpractice cases, a physician practicing with cognitive dysfunction-impaired thinking is allowed HIPPA protection, the patient/plaintiff must give up her HIPPA rights and so should the doctor so the regulator, medical board, or judge can rule accurately and put the public safety first.as any patient could potentially be harmed.

The Hippocratic Oath says “Do no harm”

This physician took the law into her own hands, putting her profits above the safety of her patients.

Petition changes are for improved oversite so no patient is harmed:

1.    In medical malpractice cases, in order to keep patients safe and get the impaired physicians the help they need, HIPPA protection needs to be waived.  Just as the patient/plaintiff must waive their right to HIPPA protection, so must the doctor so the trial judge can review.

2.    Physicians who have not self-reported within the 30-day required time period face disciplinary action and automatic oversight of their practice by the regulator regardless of the time passed or if they have healed from the condition. Fines and other disciplinary actions are to be determined by the regulator as they deem appropriate 

3.    Any Impaired physician should not be able to write prescriptions or perform medical procedures while impaired, until a treating physician of the impaired physician has given notice to the regulator that the impairment has been healed or cured.

4.    Treating physicians must notify impaired physician in notarized letter signed by both. Notifying the impaired physician to self-report within 30 days of being aware of their condition.  

5.    If its past 30 days of impairment, the treating physician will notify the impaired physician though notarized letter by both to self-report immediately.  

6.    Any treating physician can also be held accountable for any harm caused by the impaired physician who did not turn themselves in to the medical board within the appropriate time unless they have a notarized letter detailing, they did in deed notify the impaired physician to self-report.

7.    Any treating physician of the impaired physician who trains or mentors the physician while they are impaired can also be held liable if the impaired physician harms another.
