The HALT Act was enacted to prevent inmates from being placed in the Special Housing Unit (SHU) for no more than 15 days as anything over that is considered torture. The proximity law was passed in an effort to promote bonding and relationships among incarcerated parents and their minor children by moving incarcerated parents to a facility within a certain proximity to their child. Marcy Correctional Facility, as well as numerous other NYS DOCCS facilities, are continuing to violate all aspects of these enactments. They are physically harming these inmates, withholding their mail and personal property, withholding food trays, hygiene products, ripping up grievances and appeals that these inmates have the right to utilize, etc. My husband was moved to Marcy Correctional based on the proximity law to be close to his children. He was recently issued a fabricated Tier 3 ticket (non-violent) and sentenced to one year in SHU, one year loss of phone and tablet privileges and one year loss of visits. By doing this, DOCCS has completely cut off his communication with the outside world, his family, his children. They are violating HALT on many levels and manipulating interpretation of the Directive to impose these harsh sentences. They do not move inmates to alternative units within 15 days allowing them to be out of a cell for 7 hours a day. They are not supposed to impose visit sanctions or phone sanctions while an inmate is in segregated housing due to the significant mental health ramifications that come along with being confined to a cell for 23 hours a day. They all protect and cover for each other so they are able to get away with this severe mistreatment without any repercussions.  It is happening everywhere in DOCCS and it needs to be stopped. Please sign, not only for my husband but for someone else’s husband, friend, brother, son, father, mother, sister, daughter. Incarceration is supposed to rehabilitate these individuals, not destroy them physically, emotionally and spiritually.
