This bill has passed the Utah State Senate and Utah House of Representatives and is currently waiting for approval or Veto from Governor Cox. This bill moves to allow for a process for those charged with a Protective Order or Stalking Injunction in the state of Utah to expunge their records. This bill is problematic due to the already difficult and traumatic process of survivors to seek approval of such documents, that already results in under reporting of such crimes and these documents being implemented at a lower rate. The potential for further victimization for survivors by having to engage in the legal proceedings of expungement for their perpetrators, is likely to result in further trauma and disengagement from the process all together. This is due to further opportunities for perpetrators to further victimize and harass the survivors of their crimes, by forcing them to engage repeatedly in legal processes. In the case that perpetrators are able to have these documents expunged, we are likely to see an increase in victimization for further victims, as there is no public record available for future victims, courts, and victim services to refer to for public safety.
