We the undersigned

1. Seek a full parliamentary review on the efficacy of the Scottish Public Services Ombudsman and the Scottish Public Services Ombudsman Act 2002 underpinning it.

2. The removal of open-ended timescales at level 1 and 2 where a victim is unable to refer the matter to the SPSO until such time as the public service responds to the initial complaint, with mandatory timescales allowing automatic referral, the failure to respond there-in forming a matter of maladministration to be investigated by the SPSO in addition to the original matter under complaint.

3. A full review of timescales for the SPSO to conduct investigations and targets there-in set, a final response within 6 months (not years).

4. A change from "recommendations" to "rulings" with "notices of compliance" making compliance with opinions of the SPSO mandatory, not optional.

5. Fixed timescales for compliance with those rulings and statutory timescales which demand that if a public service does not comply, a report under Section 16 of the Scottish Public Services Ombudsman Act 2002 becomes mandatory. Removing the current "maybe aye" "maybe no" freedom which has resulted in no ombudsman initiating the process, even when the public service has accepted the final ruling of the ombudsman but has steadfastly refused to comply and remediate themselves.
