Investigation into Australian Border Force procedures
The hearing of Djokovic v Minister for Home Affairs on 10 January 2022 made references to the transcript of conversation between Mr Djokovic and an Australian Border Force Official(s). Djokovic was apparently dissuaded against accessing a lawyer, with Border Force delegates allegedly stating, "look, getting in touch wth your lawyers really isn't going to help with any of this so let's just get it done."
The case displays alarming procedural unfairness.
If Australian Border Force officials did not allow Mr Djokovic access to his lawyer when asked or dissuaded him from contacting one, reneging on their promise for additional time and pressuring him, these are egregious actions which show a flagrant disregard for human rights and procedural fairness. Without these pillars, what is holding our system together and how can we have faith in it?
The aim of this petition is to achieve an investigation into the actions of the Australian Border Force officials involved in these events, a review of the current procedures in place and such officers to be held accountable.
