We were very disapointed to learn from a post made on Facebook this last Saturday by a Lisbon Law Faculty lectured "... the TCA-Sul (appeal court) revoked the embargo that had been awarded to PALP by the Loulé fiscal and administrative court which had placed on hold the Galp/ENI TUPEM licence. The TUPEM was the licence which would have enabled ENI to proceed with the drilling off the Algarve coast. "(Proc. No. 243 / 17.8BELLE, and the date the Appeal court revoked the previous award and awarded in favor of government/Galp/ENI was 02/1/2019)
 
What this means is that the embargo that PALP had was cancelled by the appeal court on 1st February 2019.
 
We are just glad that ASMAA’s injunction is still active, because had ASMAA not proceeded with legal action when we did, the chances are that we would have had GALP/ENI drilling in our waters by this summer after they had obtained an extension to their TUPEM licence. As things stands currently, such a risk has been averted and will not happen as our injunction is still very much active and alive.
 
What will happen in our own case? We don’t really know at this stage, because many different legal outcomes are possible that can be for our benefit or for Gov/Galp/ENI benefit.
 
The major difference in our cases, is that PALP targeted the TUPEM only, while ASMAA targeted the underpinning law, the contracts and the TUPEM. As a result we hope for a positive outcome, one that will help us to protect our coast. ASMAA’s tireless team has done everything that could be done, now its in the hand of the judge from Loulé court. We just have to be patient while we wait for the court decision on our injunction.

AN URGENT APPEAL FOR DONATIONS

We needed to raise 2455€ by the 8th of February, and although many heard our appeal, for which we are deeply grateful, the fact is that we are still nearly 1000€ short and seriously overdue. In addition by next Monday we will be facing new accounts that will have to be paid and right now I haven’t a clue how we will manage that without your support. These are accounts for work done by people that have supported not ONLY us but also ALL of you as we progress in this battle.

As we’ve said before, we are not professional fundraisers, and it does take it out of us.

Caros Patrecionadores, Amigos e Apoiantes

De acordo com uma notificação feita no Facebook no sábado passado por uma professora da Faculdade de Direito da Universidade de Lisboa, “ … o TCA-Sul revogou a decisão da juíza de Loulé sobre a suspensão de eficácia do TUPEM que permitiria ao consórcio ENI fazer um furo de prospecção de petróleo na costa algarvia. “ (Proc. Nº. 243/17.8BELLE, e a data: 1/02/2019)

Isto indica que o Procedimento Cautelar da PALP, infelizmente, caiu no dia 1/02/2019.

E significa, também, que as concessionárias poderiam ter aproveitado o tempo de suspensão dos contratos, após esta data, não fora o Procedimento Cautelar da ASMAA a travar esse potencial aproveitamento. De facto, não fora a ação da ASMAA, as concessionárias poderiam furar até ao Verão. Este era um risco iminente e bem plausível, que foi anulado pelo nosso atempada Procedimento Cautelar.

Mas, e com a queda da providência cautelar da PALP, as concessionárias poderiam ter pedido um novo TUPEM. Poderiam, todavia não podem, porque a providência da ASMAA tem os contratos suspensos bem como todos os actos que conduziram à sua celebração.

O procedimento cautelar da PALP circunscreveu-se, apenas, a vícios do TUPEM. Mas a ASMAA, para além de um procedimento cautelar, tem uma ação principal sobre os contratos e, inclusive, sobre a inconstitucional orgânica do Decreto-lei... Ora, acresce as queixas de crimes de lesa pátria à PGR (que deu origem às buscas da PJ) e, ao Tribunal de Contas. E assim, há muitas hipóteses jurídicas para o desfecho desta batalha. Que nos podem beneficiar ou beneficiar as concessionárias.

Felizmente, ainda estamos a aguardar o resultado da nossa ação a decorrer no TAF de Loulé, a qual, como atacou os contratos, poderá vir a ter um desfecho muito diferente da ação da PALP. Temos esperança num resultado positivo que irá ajudar-nos a proteger a nossa costa. A nossa incansável equipa fez tudo que podia ser feito. Agora é esperar pelos resultados e pela decisão do tribunal.
