The COVID-19 pandemic is one of the largest public health challenges the United States has faced.  The elderly and those with chronic conditions are the most vulnerable.  To help reduce the spread of the virus to these vulnerable people, many experts have recommended practicing social distancing and staying at home as much as possible.  The counties that make up the San Francisco Bay Area, as well as various other counties in California, have gone further, imposing mandatory shelter-in-place orders where residents are prohibited from leaving their homes except for performing "essential activities."

Mandatory shelter-in-place orders are a violation of the Fifth Amendment of the United States Constitution, which states, "No person shall be ... deprived of life, liberty, or property, without due process of law."  While the Supreme Court has recognized exceptions in cases of insurrection and war, and while it is constitutional to quarantine those who have been infected with COVID-19, it is un-constitutional to impose restrictions on the movement of those within a geographical area without due process.

We urge our leaders to obey the Constitution and repeal these shelter-in-place mandates.  In these uncertain times, Americans need reassurance from their leaders that the rights protected by our Constitution will not be infringed.
