We, the small business owners, employers & employees, and citizens of San Diego County, do hereby petition the County of San Diego & its Board of Supervisors, and the State of California and its Governor to eliminate and/or adjust COVID-19 related Executive Orders & Public Health Orders which unfairly target and negatively impact specific business sectors, and all related business owners, employers, employees and customers of these business sectors. In particular, the restrictions prohibiting indoor service for restaurants, gyms & personal care services:

a.    are arbitrary & capricious in nature

b.    constitute a breach of contract as relates to all business operations and permitting requirements by the County & State for these businesses;

c.    have no foundational basis in fact, accepted data or other meaningful measure as relates to the safety of the public;

d.    have a grave impact on the health & well being of the fiscal, emotional & mental health off all peoples related to these businesses, including as customers, in direct conflict with the stated purposes of public health interests as statistically proven (a foundational basis in fact) with accepted data & other meaningful measures demonstrating the deleterious impact on public health [increases in addiction, suicide, depression, anxiety, domestic violence, etc.]

e.    and fail to meet the burden of rationality & fairness when these business sectors arguably met a much higher burden of sanitation and safety, both as part of standard business practices for these industries for previous decades, and increasingly so by adherence to the much more stringent practices as imposed through COVID-19 related health orders.

f.     It should also be noted that the failure to apply equally stringent practices, or rather greater requirements, to those industries represented by multi-billion dollar conglomerates whose business operations present substantially greater risks puts the lie to the “necessity” of these prohibitions affecting our small businesses. If substantial health benefits are derived from prohibiting indoor dining and indoor gym usage, and from prohibiting personal care services, then the higher standards adhered to by these industries would also be imposed in all retail & service establishments, a. regularly sanitizing every surface & object touched by one guest before use or touching by another guest; b. recording every guest’s name & phone numbers; c. monitoring guests at all times to assure adherence to mask wearing & social distancing while in the business facilities, etc. There would also be a restriction on the sale of any non-essential goods, including online sales, as the processing of such non-essential goods unnecessarily exposes employees to risk.

We demand this injustice be immediately corrected by ReOpening small businesses.
