People are caught by surprise when they receive a Congestion Charge Penalty Notice. Mostly this is due unintentionally entering the congestion charge zone, not remembering to pay, unable to pay due to not having on line facilities, or parking restrictions to enable the driver to make the payment, or the CC website being down. The congestion charge authority must issue a notice for any unpaid CC and allow 14 days for it to be paid before the penalty is chargeable. The penalty is extremely disproportionate and drivers are being punished for not paying the charge on the same day. CC is a civil debt and as such, it should be subject to all rules that apply for civil cases. This means that unpaid charges must be pursued by TFL through the County Court and must issue summons and must follow ALL the Civil Procedure Rules (CPR) and bailiffs appointed must be by the court that deals with the matter and  not those contracted by TFL. The process used at the moment contravenes UL Civil Law and CPR.
