Equality Now joins the demand for Lucia's life

Comité de América Latina y El Caribe para la Defensa de los Derechos de las Mujeres (CLADEM)

Feb 23, 2019 —

11 year-old Lucia (Tucumán, Argentina), a pregnant child rape victim

Lucia (fictitious name) a, 11-year-old girl, originally from Burruyacú, in the Province of Tucumán in Argentina,  was raped by a 65 year old man. She became pregnant as a result. The state seems to be doing everything it can to force her to continue with the pregnancy, putting her life at risk, despite her numerous requests to terminate.

We request that the Government of Argentina comply with its international obligations and with internal standards so Lucia can be guaranteed in an urgently and with due diligence:

Acknowledge that this child is the victim of a crime and should not to revictimized by prioritizing the life of the fetus over her own.
The measures necessary to guarantee her right to life, to health, to privacy in personal and psychological integrity, and to repair the damage to her as a victim of crime;
Ensure her health is prioritized by expert care, including access to abortion, if safe..
Access to justice with the support of sensitive professionals trained in specialized care for girl victims of sexual violence;
All of her rights are reinstated and protected.
Accountability for her perpetrator.

We also call on the Argentinian Government to implement measures to ensure this case is not repeated, as this is one of many similar cases that have been made public in the country, where services are delayed, the decision of the minor is obstructed, fetal viability is prioritized over the life of the girl, and judgments are not attached to scientific evidence.

Finally, we ask that public policies and protocols be implemented with a focus on rights and through a gender lens, in order to prevent, treat and heal, with a focus on girl victims.
