Franklin County Court to set in for Quincy Township
Quincy Township in Franklin County, Pa needs help from the Commonwealth of PA to step in and take control. 2 of 3 supervisors(Gunder and Wilson) resigned, so per the second class township code the vacancies should have went to the court of common pleas. Instead the last remaining supervisor Kerry Bumbaugh who is under indictment by the 45th state wide grand jury continues his reign over the township of Quincy. Bumbaugh and the vacancy board chairman Jim Bakner(Bakner was appointed by supervisor Kerry Bumbaugh and Former supervisor Robert Gunder in January if 2021) have taken an illegal action and appointed a new supervisor in Gunder’s seat. The Townships solicitor Linus Fenicle helped/advised them on August 5, 2021(at a special meeting) to activate the vacancy board. At the activation of this protocol, vacancy chairman Jim Bakner and supervisor Kerry Bumbaugh appointed Tabb Justus as supervisor in Former Robert Gunder’s seat. Tabb Justus is the husband of the Quincy Townships secretary. On August 13, 2021, Bumbaugh and Justus intend to hold another special meeting where they intend to appoint a unknown new supervisor in Former Supervisor Ed Wilson’s seat. Bumbaugh continues to stack the board in his favor. He continues to control the township even though he has been asked by multiple residents and politicians to resign and step down. Robert Gunder submitted a resignation letter on June 22, 2021 to the townships secretary. Edward Wilson submitted a resignation letter to the townships secretary on July 22, 2021. Neither of these resignations were accepted prior to August 5, 2021 special meeting. Thus creating 2 vacancies on the Quincy Township Board of supervisors. The law clearly states that Pa Act 69. Section 407. (e) “If two or more vacancies in the office of supervisor occur on a three-member board, or three or more vacancies occur on a five-member board, the court of common pleas shall fill the vacancies upon presentation of a petition signed by at least fifteen registered electors of the township.” The Commonwealth of Pa is being call upon to step in, investigate, and reverse any and all actions taken on August 5, 2021. Furthermore, the commonwealth is being asked to appoint 2 neutral supervisors for the 2 open vacancies of Gunder and Wilson. Furthermore, we ask for the commonwealth to remove Kerry Bumbaugh from his power and seat over Quincy Township. Furthermore, we ask the commonwealth to remove solicitor Linus Fenicle for his misconduct of the illegal action above and replace him with a neutral solicitor.
