Two North Carolina brothers and fathers of nine minor American citizen children face imminent deportation by ICE. They are scheduled to be deported today. After 25 years of ICE allowing Jose and Drario Delgado to remain provisionally in the country, they were handcuffed and detained check-in in Charlotte, North Carolina right before Thanksgiving during an immigration check-in. They do not have criminal records. They are the victims of immigration legal malpractice – the brothers were going through the process to gain residency however their attorney withdrew a critical petition. The mistake was not caught until they hired a new attorney this year, however by then ICE closed their case and ordered them removed. They have pending motions before the Immigration Board of Appeals, however ICE intends to deport them before their motions can be heard. If deported it will costs taxpayers about $25,000 to pay for the deportation process.  Once they are deported their nine American citizen children will need to file for EBT benefits, at a cost to taxpayers of over $20,000 annually.  They will also qualify for public housing if their fathers are deported as they will no longer be able to pay for their current homes. 

Deporting the Delgado Brothers is physically irresponsible choice for taxpayers and a morally bankrupt choice for their children. 

 Yesterday their children, family members, church members, and communit members met at the North Carolina GOP Headquarters to ask GOP Chariman Robin Hayes to call ICE on their behalf and ask them to use favorable prosecutorial discretion so the brothers can be released to their families and their motions can be heard before the immigration court of appeals. The GOP locked their doors, would not answer phone calls and called the police. Yesterday was also Dario's son Luis' fourth birthday. He spent his birthday at the GOP asking for support only to have his cries silenced by indifference and locked doors.

Once deported their nine minor American citizen children will be forced to rely on EBT for food and public housing for shelter. Both place a burden on taxpayers. The families qualify for over $20,000 annually in EBT once their fathers have been deported.
