The right to a view and no loss of value for a home or property owner is denied by the current planning system. The extra rub is that Supplementary Planning Policy often requires new build applications to make the most of any view. Once built the new owner finds that right to the view is removed. The gain by a developer in taking that view from a home or property owner is morally wrong as is the loss to the owner. The original 1610 act was quickly put in place to allow landowners to develop their land when the land use was less intense but does not suit the current climate.

Some assessment of the value of the view should be made as part of the planning process and some compensation given in return for a consent.

How can any system justify a loss which is from a stolen asset for the gain of the developer in selling it to a buyer who then finds they have no right to it?
