Dear Senator Perry and Representative Grant,

After the Parkland tragedy a series of laws were enacted that significantly impacted the 2nd Ammendment rights of law abiding citizens.  These laws restricted the ability of a law abiding segment of the population from owning firearms, removed due process in background checks, and introduced the ability to remove firearms from law abiding citizens without due process.  In more detail:

The minimum age to purchase firearms was raised from 18 to 21.  This is all firearms, not just handguns.  The impact?  The 20 year old single mom with a stalker is unable to defend herself and her child.  The multiple deployment 20 year old combat veteran is unable to defend his family.  The young couple just starting out are unable to protect themselves from the ever growing threat of home invasions.

Background checks were changed to allow a status of "Pending", and not "Conditional non approval", with no appeals process or mandatory time for resolution.  Florida is the only state to have an additional layer of background checks at the state level, preventing some checks from ever reaching the NICS federal background check system.  Prior to this legislation, a background check involved a computerized automated check.  If there was anything that was not filed correctly, or had occurred anywhere in the past that required a human eye to review, a conditional non approval would be issued.  There was a maximum resolution time of 3 days to determine if the applicant could own a firearm or not.  With the changes that came into existence, a status of "Decision Pending" came about.  When the applicant is marked Decision Pending, there is no appeals, no mandatory resolution time, and no additional information provided.  This is an indefinite status with examples already appearing where people are waiting 9 months without resolution, and no indication of what resulted in the status.  The impact?  Law abiding citizens are being denied the right to purchase firearms and are being denied due process for a potentially arbitrary decision.

"Red Flag Laws" were enacted that enable the confiscation of firearms by law enforcement without due process.  This action can be initiated by an individual without evidence or justification that a risk or threat exists.  Already one individual has been killed during one such confiscation and in excess of 450 firearms have been confiscated in Florida, the majority of which occurred in Broward County.  The impact?  Law abiding citizens are being stripped of their constitutional rights with no justification, investigation, examination, or due process based on the words of individuals who have potential personal agendas against the individuals.

We are asking that you support HB175 that revokes these measures.  We are also asking that the FDLE Florida only backckround check system that is only used by the state of Florida, be removed enabling the Federal background check system to function in the same capacity as with every other state in the nation.
