Why this petition matters
Jammu and Kashmir Administrative Services (JKAS) examination is a State Civil Service Examination (CSE) conducted by Jammu and Kashmir Public Service Commission (JKPSC). Following the Union Public Service Commission (UPSC) pattern of conducting the Central Civil Service Examination, the exam in J&K should have been conducted in a similar manner every year. However, due to the lackadaisical attitude of JKPSC, the exams haven't been conducted punctually. Since 2014, Civil Service Examination (CSE) in J&K has been conducted only four times when it should have been conducted eight times.
Despite being aware of the fact that the Commission has failed to conduct exams on time, J&K GAD introduced SRO-103 in the Combined Competitive Examination (CCE) rules in 2018 which puts the age cap of 32 for appearing in the examination. In 2021, after the intervention of the LG J&K, Shri Manoj Sinha, only one-time relaxation was granted to the aspirants. How on earth would a one-time relaxation be able to correct the wrongs committed by the Commission in all these years? Years of hardwork, time, and energy have all gone to waste, and a mere one-time relaxation will not compensate for this huge loss.
The Commission should have taken into account the age limit before delaying the exam every other year. J&K GAD should also understand the situation it has put the aspirants into, where, we, aspirants have been forced to write petitions and approach the authorities for what rightfully belongs to us. The insensitive approach of the Commission and J&K GAD has robbed the genuine aspirants of their rightful attempts.
JKPSC hasn't ever been able to conduct exams on time, however it has now decided that it would follow the UPSC pattern and conduct J&K CCE on time, this step is, no doubt, laudable but it would benefit only the future aspirants. What about the aspirants who have been preparing for years but have lost their previous attempts due to the inability of JKPSC to conduct J&K CCE regularly?
We request J&K LG Shri Manoj Sinha, J&K General Administrative Department, and J&K Public Service Commission to revise the age criteria and kindly put the age cap of 38-40 for appearing in CSE, considering the failure of the Commission to conduct exams on time.
