Please bring down litigations from government agencies by fixing responsibility in cases.
Departmental cases pending at various levels of the judiciary across the country are in lakhs. Litigation process is lengthy and time-consuming in India. Valuable court time can be saved and may be spent in resolving other important pending cases.
Govt. should never forget the basic principle i. e. responsibility to protect the fundamental rights of employees which is also absolutely necessary to protect their work efficiency.
Departmental cases are mostly always regarding transfers, promotions, Pension, Bill claims, increments etc. and their origin always personal grudges, vindictive attitudes from egocentric, corrupt Bosses.
Hence, Government must not be the compulsory Respondent in such cases when the facts & results of the cases points to the origin of the cases as " Intentional or un-intentional deriliction of duties from few senior officers.
The officers responsible for cases enjoy the perks of TA- DA, Paid Leave - duty period, Lawyer fee - other expenses etc entire man-machinery of Govt. at his hand . He even pay no heed to results of case as appealling in uppar court is easy for him.
It's highly demoralising for an applicant who already faces Harassment and now have to spend time, money, health everything in fighting case, that way disturbing financial, Physical, Mental, Social health.
Many applicant ultimately win but very late i. e. After sufferring enough injustice. This is cruelty to any Government official who joins Government to offer his services to Nation.
The Government must look in to this and thoroughly enquire the matter before it approaches to court. The departmental gravience redressals must be speedy and to the satisfaction of justice seekers.
The role of any officer being reason of origin of the conflict must be traced out and culprits must be punished. The results of the cases must be a responsibility for them. No financial help offered as perks mentioned above to the officers from respondent side.
Then only litigations will reduce. The irrant officers will have check, corrupt practices will be reduced and employees have stress - free environment to work.
