The Zoning Board must follow the Town of Kingston Zoning Ordinance precisely before granting any Special Exception for a gas station.  No corners can be cut.  Before moving forward, the ZBA must engage a qualified expert consultant to determine IF adequate groundwater protections can be developed to protect the Aquifer Protection District.   If adequate protections can be developed by a qualified expert, the ZBA must impose those protections as conditions to the Special Exception.  If adequate protections cannot be developed by a qualified expert, the ZBA cannot grant a Special Exception for a gas station.  These are the plain and clear requirements of the Town of Kingston Zoning Ordinance.
