The Canadian Bill C-36 opposes the Canadian Charter of Rights and Freedoms. This Bill is unconstitutional as it infringes upon the autonomy of Canadian individuals to work in the sex trade, which is in contrast to Section 7 of the Charter. Bill C-36 still renders sex work virtually illegal as many necessary components of sex work remain criminalized. Sex workers cannot live off the avails of sex work nor can they communicate for the purpose of their trade. The current minimum wage is not a living wage and many Canadians turn to sex work in order to survive.
A repeal of Bill C-36 along with the implementation of progressive legislation would allow for the autonomy of all Canadians. A repeal of this unconstitutional Bill would allow for safer work conditions for sex workers, legitimize their work, and workers would be at less risk of being trafficked. Sex work is work and must be recognized as such in the eyes of the Canadian Government.
