REJECT Mooney-Engle Land Company conditional use pursuant to the conditions placed on Ordinance No. 13-14-4(K) to allow for a permitted restaurant to have hours of operation extend into the times between 11:00 p.m. and 6:00a.m. Case #14-02C

The Marion zoning and planning commission meeting on 1/13/15 approved a conditional use permit to change to hours of operations for a proposed restaurant and bar to be open until midnight on weekdays and 1 am on weekends (current zoning allows businesses to be open between 6 am and 11pm). This restaurant will be located at 900 Barrington Pkwy, on the corner of Barrington Pkwy and Stonefield Rd, right next to Clemenson Chiropractic, with entrances to the lot via Stonefield and Barrington. This parcel is directly across street from Linn Mar High School, Excelsior Middle School, and single-family residential homes. Please sign this petition to show you DO NOT approve of this type of business operating at these hours in this location.
There is one more hearing next Tuesday, 1/20/15, at 7pm at Marion City Hall where the Zoning Board of Adjustment will approve or deny the permit. If you have a strong opinion on this topic, I would encourage you to attend the meeting and/or send an email to the city manager and zoning board of adjustments if you have personal testimony in addition to this petition.
By signing this petition, you are acknowledging you are against this conditional use permit and agree in one or more of the following areas:
-Marion does not need businesses open between 11pm and 6am directly across from schools and single-family homes due to noise, safety, and property value concerns.
-Marion does not to need to increase traffic to residential streets and to already congested areas.
- Marion does not need to mix inexperienced high school drivers coming from late evening activities and patrons of a bar at 12am or 1am
- Neighboring businesses do not want vandalism to their businesses due to late hour patrons
- We need better planning and zoning rules to ensure the current rules stand and do not set this precedence for the future as we grow.
- YES, we want to attract businesses like this to Marion. We want a "leakage free" community that supports businesses and residences. We want Marion to have more reasons to move here, not less. We want to increase revenue for the city and reduce residential taxpayer burden to do so. We want to have a family friendly business for visitors to Linn Mar schools and families attending school functions to be able to enjoy. We need to retain our image of a family friendly community who offers world class education and safety for its citizens. We want Tower Terrace road to provide better access to major interstates and roadways. NO, we do not want this business at this location with these hours due to our concerns.
