The Government is seeking submissions on the Property Management Industry and looking at the Regulation of Residential Property Managers. This petition seeks to include Kainga Ora Housing Support Managers to be Regulated by a separate Independent Agency. Kainga Ora Housing Support Managers should be licensed and be Regulated. 

This Safeguard is to Protect Tenants from Abuse of Power and to prevent the ongoing stonewalling and turmoil tenants face in trying to uphold their Tenant Rights. Kainga Ora is managing the handling of complaints about their own Organisation and the process sifts many complaints to the wayside proir to a Tenant getting their case heard at the Tenancy Tribunal.  There are many thousands of tenants who have been deprived Repairs & Maintenance that fall under landlord responsibility, and there is more than a small number of elderly, sick and terminally ill Kainga Ora tenants being stonewalled in their efforts to get a working heat pump. It is important that tenants feel safe from their Tenant and human Rights being violated by over reach tactics of Kainga Ora and that their Tenancy Manager/Housing Support Manager is fulfilling Legal Obligations, being law abiding and held Accountable.  

There is a lengthy history of HNZ/ Kainga Ora failing to met their obligations as a state landlord. A further example of this is that they have publicly declared defiance to upholding sections 38 & 45 of the RTA, as a direct result thousands of members of the public are being intimidated and terrorised by disruptive hooligan behaviour of Some KO tenants for a period of time that leaves long lasting scars, PTSD, ruins families and can lead to death etc.

The ongoing Trampling and erosion of Kainga Ora Tenants Rights means it is critical that Kainga Ora Housing Support Managers are Regulated by an independent agency, and licensed. This would provide a professional standard across the Property Management Industry. This is necessary to end Abuse of Power and deprivation of Human and Tenant rights across NZ, which has also impacted on non Kainga Ora Tenants and home owners. Instead of KO being held Accountable for non compliance with Repairs and maintenance on KO properties, lack thereof, and breaches of s38 & 45 of the RTA  they have made changes...changing the Kainga Ora Tenancy Managers Title to Housing Support Managers - this is Wrong and they are not Qualified to play "social workers", furthermore it is to further overstep the boundary line between landlord and tenant (which the RTA exists to protect as well as set out the Obligations & Responsibilities of each party). 

What could Regulation look like for State Kainga  Ora Housing Support Managers, these would differ slightly to private sector and could be set as follows:

* Have a minimum level of qualification to be licensed such as the NZ Certificate in Property Management Level 4 (or equivalent).

* Have ongoing education obligations to ensure they stay up to date with Tenancy Law and Law Changes.

* Be required to have Police and background checks before getting a license. 

* Adhere to a mandatory code of conduct  or set of standards to keep them Accountable in Accordance with the Private Sector Regulating the Standards of Residential Property Managers - as well as Kainga Ora Housing Support Managers, which overseeing their standards in the profession should be overseen by a separate independent agency.

* Be subject to fines or sanctions if they don't follow the code of conduct or standards and/or if their failure or actions results in tenants being harmed which could be done by the Regulating independent Organisation.
