The Issue

In a recent move, President Donald Trump deployed National Guard troops to Los Angeles without Governor Gavin Newsom’s consent, citing that federal immigration operations—specifically ICE enforcement—were being threatened by protest activity. This happened despite public statements from both Governor Newsom and the LAPD that the situation was under control. That moment revealed a serious flaw in Title 10 of the U.S. Code and the Insurrection Act (10 U.S.C. §§ 251–255): right now, a president can send military troops into a state without independent verification or state approval, simply by claiming that federal operations are being disrupted. If we don’t close this loophole, any future president could use this same power to respond to peaceful protests, override local leadership, or deploy troops in domestic situations without real oversight or accountability. That’s a dangerous threat to civil liberties, state authority, and the constitutional checks and balances this country was built on.
