Under the current definition and Administrative Code, relatives and friends are prohibited from caring for and burying their own dead. This prohibition unduly burdens the citizens of Illinois with exorbitant, compulsory costs often in the tens of thousands of dollars. Moreover, the required practice of utilizing a licensed funeral director for death care and burial are ecologically unsustainable, and in contrast to many cultural and religious practices.
