In the case of George Maldonado v. Commonwealth of Virginia, a blatant miscarriage of justice demands corrective relief and general leniency on behalf of Mr. Maldonado in light of the circumstances. Case #CR09-4773-00, CR09-4773-01, CR09-4773-03, CR09-4773-04, CR09-4773-09, and CR06-1049.

Mr. Maldonado was arrested and charged with several crimes from two (2) separate occurrences in Virginia Beach (Virginia) after being identified as a suspect by a Mr. Williams, whom at the time was under the influence of marijuana and whom himself was charged as a suspect in one of the same crimes. Mr. Williams identified Mr. Maldonado, and one other individual as suspects for the crimes committed. These crimes were the robbery of a Mr. Dunton on September 29, 2009, and the carjacking of a Ms. Mandy on October 11, 2009.

In the case of robbery, Mr. Dunton testified that he only identified Mr. Maldonado as a suspect because the detective kept showing him Mr. Maldonado' photo. The repetitiveness of which the detective continuously showed Mr. Dunton can be deemed suggestive and compelling in nature. However, there was no physical evidence tying Mr. Maldonado to this crime because he did not rob Mr. Dunton.

In the carjacking of Ms. Mandy, Ms. Mandy testified that no firearm was used in the crime against her. She stated that she only seen a firearm as a result of Mr. Williams getting out of the car. She also admitted that she had relations to Mr. Williams. In this instance, the firearm was found at the feet of Mr. Williams, however, Mr. Maldonado was still charged with the firearm.

One can realistically draw from these facts that in efforts to free himself up from being a suspect, Mr. Williams put the blame on Mr. Maldonado.

Mr. Maldonado , in efforts to take full responsibility for his involvement in the carjacking of Ms. Mandy, agreed to plea guilty to all charges despite his relentless desire to challenge the robbery charge of which he asserts his innocence of. This plea agreement landed Mr. Maldonado with a sentence of 18 years. In addition to this lengthy prison sentence, Mr. Maldonado was subjected to a probation violation of which he was sentenced to an additional 10 years to be served consecutively with the 18 years: totaling 28 years.

Mr. Maldonado has served over 9 years of the total 28 year sentence, and has used his time completing programs, learning knew things in efforts to open his mind to knew things and better ways of living, reflecting on his past to clearly identify where he went wrong as well as what he could have done better/differently, and working to build stronger bonds with his loved ones and associates. Mr. Maldonado has not been in any trouble and has maintained an infraction free institutional record for over 4 years.

In light of the facts and overall circumstances of this case, we support early release for Mr. Maldonado and move the honorable Governor of Virginia and all designated review personnel to grant conditional pardon relief on behalf of Mr. Maldonado.
