In an age where the prison industrial complex has grately tainted our American justice system, another blatant miscarriage of justice plagues the very life of Daniel Buchanan, and we the people, seek justice in favor of Daniel Buchanan the form of a sentence commute/early release.

Back in November 2012 Daniel Buchanan arranged for his girlfriend and her two young daughters to move in with him. Later, out of the kindness of his heart, Mr. Buchanan also allowed a female friend of his girlfriend to live with them temporarily at his residence because she had encountered some hardships and was homeless at the time. This female friend of Mr. Buchanan‘s girlfriend had a boyfriend of which was allowed to come visit her at Mr. Buchanan‘s residence. The female friend and her boyfriend had a fallout for whatever reason and this fallout resulted in her now-then ex-boyfriend showing up spontaneously trespassing, making threats, and causing problems.

Once it became a daunting fear and concern, the police were called while the ex-boyfriend was still on Mr. Buchanan premises. At that point the situation was explained to the police and the ex-boyfriend was made to leave. It was made clear to the ex-boyfriend that he was NOT welcome nor allowed to return to Mr. Buchanan‘s premises. The ex-boyfriend continued to show up spontaneously trespassing, making threats, causing problems, and placing Mr. Buchanan‘s household in fear of harm. Despite contacting the local police for assistance, Mr. Buchanan received NO immediate longterm resolution.

During the ex-boyfriend's last and final spontaneous show up, he became abnormally enraged at Mr. Buchanan‘s natural instinct to protect the wellbeing of his household. In his enraged state, the ex-boyfriend attacked Mr. Buchanan and in an intense moment of fear and panic, Mr. Buchanan accessed the gun from his person and shot the ex-boyfriend. Daniel Buchanan immediately called 911, informed them of the situation, and followed their instructions. Mr. Buchanan was later notified that the ex-boyfriend had died from the gunshot.

Mr. Buchanan was charged with one count of "2nd degree murder" and one count of "use of a firearm in commission of a felony". At trial, Mr. Buchanan plead not guilty by means of self-defense; however, the aim of local police and the prosecution was simply to have Mr. Buchanan convicted for these charges no matter the actual facts leading to the unfortunate death of said ex-boyfriend. Mr. Buchanan retained an attorney (of whom seemed to have deliberately functioned ineffectively) and ultimately was convicted in 2014 and sentenced to 43 consecutive years in prison.

Unlike the many career criminals that possess records and overall histories of felonious behavior, Mr. Buchanan has NO prior record of violence nor felonious behavior, and therefore should have received the utmost leniency in light of the circumstances. In an instance of self-defense, anything can happen. No one knows exactly what will happen until it actually happens. Therefore, the unfortunate death of said ex-boyfriend should not in any shape, form, or fashion be or have been deemed premeditated.

Mr. Buchanan done what any morally responsible person would do and should not be subject to the harsh and extreme sentence of 43 consecutive years in prison, and therefore, we the people petition the honorable Governor of Virginia to grant Mr. Buchanan clemency by means of a sentence commute.
